Terms of Use, Privacy & Data Policy
These Terms of Use, Privacy & Data Policy govern how ShareDay may be used and how personal information is collected, used, stored, and deleted when you use ShareDay.
By creating an event, joining an event, uploading content, or using any part of ShareDay, you agree to this policy.
If you do not agree, do not use the service.
1. Company Definition
ShareDay is owned and operated by Dillon Collective Limited, a New Zealand registered company (“DCL”, “we”, “us”, or “our”). References to “ShareDay” in this policy refer to the ShareDay platform operated by Dillon Collective Limited.
2. What ShareDay Is
ShareDay is a platform that allows users to create and manage events.
We provide the tools. Users provide the event, guests, content, and decisions about how the event is run.
DCL is the platform operator. DCL is not the event host, organiser, childcare provider, venue operator, or publisher of guest content. DCL is not responsible for what hosts or guests upload, share, or say.
3. Roles and Responsibilities
Event Hosts
If you create or organise an event, you are the Event Host.
Event Hosts are responsible for:
Inviting guests to the event
What information they collect from guests
Which features are enabled, including galleries and guestbooks
Who can access or view content
Ensuring they have permission to collect, use, and display guest information
Moderating and managing event content
Responding to correction requests where required under the Privacy Act 2020
Guests
If you are invited to an event, you are a Guest.
Guests are responsible for:
Ensuring that the information they submit is accurate
Any content they upload or post
Ensuring they have permission to share that information or content
4. What Information We Collect
We only collect information needed to run an event and operate ShareDay.
Depending on how an event is set up, this may include:
Names
Email addresses
Phone numbers
RSVP responses
Messages, notes, or guestbook entries
Photos, videos, or other media uploaded by users
Basic technical data such as IP address, browser type, and device information
Guests choose what information they provide. Hosts choose what information they request.
5. How We Use Information
Event Hosts and Guests authorise DCL to use collected information to:
Operate event features
Display content to permitted users
Send event-related messages such as invitations, reminders, and updates
Maintain system security, functionality, and support
Promote future events or advertise the ShareDay platform
We do not sell personal information.
6. User Content
“User content” includes guestbook messages, photos, videos, captions, comments, names, messages, and any other uploads or submissions.
You retain ownership of your content.
By uploading content to ShareDay, you confirm that:
You have the right to upload it
It does not violate any law or third-party rights
It complies with this policy
ShareDay does not pre-screen or approve content before it appears.
7. Event Visibility and Sharing
Event Hosts control whether an event is public or private, who can view content, and which features are available.
Guests and Hosts should assume that:
Content may be viewed by others who are permitted to access the event
Content may be downloaded, copied, screenshotted, or shared by others
Once shared outside the platform, content may no longer be controllable by ShareDay
ShareDay is not responsible for how users share or misuse content they are permitted to see.
8. Acceptable Use
You must not use ShareDay to:
Upload illegal, harmful, or abusive content
Harass, threaten, or impersonate others
Upload content you do not have permission to share
Attempt to access events or data without authorisation
Interfere with the platform or its security
Any content involving exploitation, abuse, or sexualisation of minors is strictly prohibited and may be removed and reported to authorities where required by law.
9. Content Moderation and Removal
We reserve the right to:
Remove content
Disable features
Suspend or terminate access
This may happen without notice and at our discretion if content or behaviour breaches this policy or applicable law.
We are not required to explain or justify moderation decisions.
10. Availability, Hosting, and Changes
DCL will use reasonable endeavours to keep ShareDay available at reasonable times. However, we do not guarantee uptime, availability, error-free operation, or that features will remain unchanged.
We may change features, limit functionality, suspend, or discontinue parts of the service at any time.
ShareDay relies on third-party service providers, including hosting and infrastructure providers, to operate. We do not own, operate, or control these systems and are not responsible for outages, downtime, data loss, performance issues, or service interruptions caused by third-party providers.
ShareDay is provided “as is” and “as available”. We make no warranties or representations, express or implied, regarding reliability, availability, performance, uptime, accuracy, or suitability for any purpose.
Use of the platform is at your own risk.
11. Payment and Refunds
Payment for the use of ShareDay or any additional features, if applicable, must be made in full before use.
If payment is not received, is cancelled, or is reversed, ShareDay, the event, and/or the relevant features may be suspended or made unavailable.
DCL is not liable for any information or content lost as a result of suspension or cancellation under this clause.
No refund is payable for the use of ShareDay or any additional features if an event is cancelled, removed, suspended, or terminated under this policy.
12. Support Services
If Event Hosts or Guests become aware of issues with the ShareDay platform or require assistance using it, DCL will use reasonable endeavours to make support available Monday to Friday between 7.00am and 7.00pm New Zealand time.
13. Cookies and Tracking
DCL uses minimal cookies and similar technologies to keep users logged in, remember basic preferences, and ensure ShareDay functions correctly.
If you block cookies, parts of the platform may not work properly.
14. Data Retention and Deletion
ShareDay is not a permanent storage service.
Our approach is simple:
Event data is kept only for as long as the event is active or reasonably needed
All event data is manually deleted after the event
Deletion occurs no later than 12 months after the event date
Before deletion:
We may contact the Event Host to confirm
Hosts are responsible for saving anything they wish to keep
Once deleted, data cannot be recovered.
DCL may also remove content at any time, without notice, if it considers that content to be prohibited or in breach of this policy.
15. Accessing and Correcting Information
Under New Zealand’s Privacy Act 2020, individuals may request access to personal information we hold about them and request correction of that information.
In many cases, the relevant Event Host should be contacted first, because the host controls the event and decides what information is collected and displayed.
We may refer privacy-related requests to the relevant Event Host where appropriate.
16. Liability Limitations
To the maximum extent permitted by New Zealand law:
DCL is not liable for any loss, damage, or dispute arising from event use
DCL is not responsible for disputes between Event Hosts and Guests
DCL is not responsible for content uploaded by users, Event Hosts, or Guests
If liability cannot be excluded under New Zealand law, it is limited, at DCL’s option, to the amount paid by the relevant user to DCL for the relevant service in the 12 months preceding the event giving rise to the claim, or NZD $0 where the service was provided free of charge.
ShareDay does not provide legal, financial, compliance, safety, or professional advice. Users must not rely on ShareDay for decisions that require professional judgement.
17. Indemnity
Event Hosts and Guests indemnify DCL against any claims, losses, damages, and legal costs arising from:
Their event
Their content
Their misuse of the platform
Any breach of this policy
18. Termination
DCL reserves the right to suspend or terminate access to ShareDay at any time if DCL believes, acting reasonably, that this policy has been breached or that the actions of an Event Host or Guest may bring DCL or ShareDay into disrepute.
Upon termination:
Access to events may be removed
Content may be deleted
DCL is not required to retain data
DCL is not required to issue a refund
19. Changes to This Policy
DCL may amend or update this policy from time to time.
Continued use of ShareDay is deemed acceptance of the updated policy.
20. Governing Law and Jurisdiction
This policy is governed by and construed in accordance with the laws of New Zealand.
Any dispute, claim, or proceeding arising out of or in relation to ShareDay, this policy, or use of the platform shall be subject to the exclusive jurisdiction of the courts of New Zealand.
21. Company & Ownership
ShareDay is operated by Dillon Collective Limited, a New Zealand registered company.
Dillon Collective Limited is the legal owner of the ShareDay platform, including its software, databases, and supporting infrastructure. Event Hosts and Guests retain responsibility for the content they create or upload to events.

22. Google Business Profile Data
ShareDay partners may optionally connect a Google Business Profile they manage. ShareDay requests Google authorisation only after the partner chooses to connect, and the partner selects the business location to use.
Data accessed. ShareDay may read the selected business location identifier and public business information such as the business name, description, website, phone number, address or service area, categories, hours, photos, reviews, public reviewer details, and owner replies. ShareDay also receives an OAuth refresh token so the connection can continue until it is disconnected.
How the data is used. The data is used only to let the partner review and import selected business details and photos into their ShareDay partner profile and to sync Google reviews into ShareDay. ShareDay does not use this connection to create, edit, or delete the partner's Google Business Profile, and it does not sell Google user data.
Storage and sharing. OAuth refresh tokens are encrypted at rest. Connection identifiers, synchronised profile snapshots, photo references, imported copies, and reviews are stored only as needed to provide the connected partner feature, maintain security, and diagnose failures. Data may be processed by ShareDay's contracted hosting and infrastructure providers solely to operate the service. Information a partner chooses to publish or import may be visible on that partner's public ShareDay profile.
Partner control and deletion. Partners can disconnect Google Business at any time from the partner portal. Disconnecting removes the stored Google authorisation and synchronised Google reviews. Profile details and photos that the partner deliberately imported become ShareDay profile content and can be edited or deleted using the normal partner profile tools. Partners may also contact ShareDay support to request deletion.
ShareDay's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
23. ShareDay Partner Program and Partner Pro
This section applies to businesses, organisations, sole traders, representatives, team members, and other people who apply for, claim, manage, or use a ShareDay Partner profile or any Partner feature (collectively, “Partners”). It applies to both the Free Partner plan and Partner Pro. By applying for or using the Partner Program, you confirm that you are authorised to act for the relevant business and agree to this section as part of these Terms.
23.1 Applications, verification, and eligibility
Partner profiles are subject to application, verification, approval, and ongoing eligibility checks. Providing information or submitting an application does not guarantee approval, publication, verification, sponsorship, or any particular position in ShareDay search or Discovery results.
Partners must provide accurate, current, and complete information and must promptly correct anything that becomes inaccurate. ShareDay may request reasonable evidence of identity, authority, business ownership, qualifications, licences, insurance, location, or service details. ShareDay may decline, pause, restrict, unpublish, or remove a Partner profile where information cannot be verified, the profile is misleading or inactive, the business is not suitable for the platform, or these Terms are breached.
23.2 Free Partner and optional Partner Pro
The Free Partner plan has no recurring subscription fee. Partner Pro is an optional paid or complimentary plan that adds enhanced tools and benefits. A Free Partner account will not be converted into a paid subscription without the Partner’s express agreement to the price and billing arrangement shown at checkout.
The features available on each plan may evolve as ShareDay develops. Material changes will be communicated where reasonably practicable. Changes to plan features do not authorise ShareDay to begin charging a Free Partner account without express acceptance of a paid subscription.
23.3 Partner Pro benefits
Partner Pro may include advanced booking and business tools, managed events, team access, checklists, review replies, enhanced analytics, increased profile or media limits, Priority Support, Social Media Spotlight, Priority Listings, Discovery Favourite eligibility, or other benefits described on the current pricing or plan page.
Priority Listings means that an eligible Partner may receive increased prominence or ranking weight within applicable ShareDay listings. It does not guarantee the first position, continuous visibility, a minimum number of views, clicks, enquiries, or bookings, or placement ahead of every other Partner or supplier. Ranking may also consider relevance, location, availability, profile quality, verification, customer needs, safety, and other operational factors.
Social Media Spotlight is an editorial and promotional opportunity, not a guaranteed campaign, publication date, audience size, reach, engagement level, or business result. ShareDay may choose the timing, channel, format, creative treatment, and suitability of any spotlight and may require suitable content from the Partner.
Priority Support provides prioritised handling through the support channels ShareDay makes available. It does not guarantee an immediate response or resolution, and response times may vary according to urgency, complexity, support hours, service availability, and demand.
23.4 Host accounts, account linking, and Discovery benefits
A Partner may join or subscribe to Partner Pro without having a ShareDay Host account. Partner-profile benefits can apply independently, but any feature that operates through the Host side of ShareDay requires an eligible Host account and an approved link between the Host and Partner accounts.
If a Host account is created later, the Partner must complete the linking steps shown in ShareDay. Using the same verified email address may assist matching but does not by itself prove ownership or create an approved link. ShareDay may require confirmation from one or both account holders. Host-side benefits, including any Discovery Favourite treatment for eligible events, begin only when the required account, link, event, and eligibility conditions are satisfied. They are not applied retrospectively to periods before those conditions were met.
A linked Host account remains subject to the Host provisions of these Terms. Linking accounts does not transfer ownership of either account or make ShareDay responsible for disputes between account holders.
23.5 Partner profiles, content, and Google Business data
Partners are responsible for their profile, offerings, descriptions, prices, photos, logos, qualifications, availability, policies, links, and other content. Partners confirm that they have the rights and permissions needed to submit and publish that material and that it is not misleading, unlawful, infringing, or deceptive.
ShareDay may review, format, moderate, refuse, correct obvious display issues in, unpublish, or remove Partner content to protect users, meet legal or platform requirements, or maintain listing quality. Verification confirms only that ShareDay completed the checks it chose to perform at that time; it is not a guarantee or endorsement of the Partner’s quality, safety, solvency, availability, or suitability.
Optional Google Business connections are also governed by section 22 above. Partners must only connect and import information from a business profile they are authorised to manage.
23.6 Enquiries, messages, reviews, and analytics
Partners must communicate honestly and professionally and may use customer or Host contact information only for responding to the relevant enquiry, booking, event, or other purpose the person reasonably expects, unless another lawful basis applies. Partners must not send spam, misuse contact details, manipulate reviews, pressure reviewers, or offer undisclosed incentives for favourable reviews.
ShareDay may moderate, delay, hide, reject, or remove reviews, replies, messages, or other content where necessary to address authenticity, privacy, safety, abuse, legal risk, or breaches of these Terms. Analytics, counts, and performance information are estimates produced from available platform activity and may be delayed, filtered, corrected, or affected by privacy and fraud-prevention measures. ShareDay does not guarantee that analytics are complete or suitable for accounting or financial reporting.
23.7 Bookings and the relationship with customers
ShareDay provides tools that allow Partners and customers to exchange enquiries, booking requests, availability, messages, documents, status updates, and related information. Unless ShareDay expressly states otherwise for a particular transaction, the agreement for goods or services is directly between the Partner and the customer. ShareDay is not the supplier, agent, employer, insurer, venue operator, or party responsible for performing the Partner’s services.
The Partner is responsible for its offerings, availability, pricing, taxes, quotes, confirmations, deposits, cancellations, rescheduling, refunds, safety, licences, insurance, consumer-law obligations, and delivery of the booked service. The Partner must clearly disclose its booking and cancellation terms before confirmation and must comply with the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, and other applicable laws.
Unless a checkout page expressly says that ShareDay is collecting a customer payment, payment arrangements between a Partner and its customer occur outside ShareDay. Recording an offline payment, deposit, refund, or balance in ShareDay is an administrative record only and does not mean ShareDay received, held, verified, or refunded the money.
Customers and Partners must check booking details and communications. ShareDay does not guarantee that a Partner will accept a request, that a customer will proceed, or that either party will perform its obligations. Disputes about the underlying goods or services should first be addressed between the Partner and customer, although ShareDay may assist with platform records or safety concerns at its discretion.
23.8 Managed Events, teams, vendors, and delegated access
A Partner using Managed Events, team access, vendor tools, imports, checklists, or delegated permissions remains responsible for the event or business records it creates and for deciding who may access them. The Partner must have a lawful basis to upload or import customer, guest, team, and vendor information and must provide any notices required by law.
Account owners are responsible for inviting suitable team members, assigning the minimum permissions they need, reviewing access, and removing access promptly when it is no longer required. Actions performed by authorised team members or representatives may be treated as actions of the Partner account. Vendors and other third parties remain responsible for their own services, content, conduct, and legal obligations.
23.9 Customer information and privacy responsibilities
ShareDay processes Partner and customer information as described in sections 4, 5, 13, 14, and 15 of this policy. A Partner that receives or accesses personal information through the Partner Program must protect it, restrict access to people who need it, use it only for lawful and expected purposes, keep it no longer than necessary, and respond appropriately to access, correction, deletion, security, and privacy requests.
Partners must not export, copy, sell, disclose, or reuse customer, guest, Host, review, or enquiry information for unrelated marketing or data-brokering purposes without a valid lawful basis and any required consent. Partners must notify ShareDay promptly of suspected unauthorised access, loss, disclosure, or misuse affecting information obtained through ShareDay.
23.10 Partner Pro subscriptions and payment
Partner Pro prices, currency, taxes, billing interval, and the amount due are shown before checkout. By completing a paid subscription checkout, the Partner authorises ShareDay and its payment provider to collect the displayed recurring charges until the subscription is cancelled. Subscriptions may be billed monthly or annually as selected. Stripe or another payment provider may securely collect and store payment details; ShareDay does not receive full card numbers.
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Cancellation normally takes effect at the end of the paid billing period, and Pro access continues until then. Except where required by law or expressly stated otherwise, amounts already paid are not refundable merely because the Partner did not use the service or cancelled part-way through a billing period.
If a payment fails, ShareDay or its payment provider may retry the payment and notify the Partner. Pro access may enter a recovery or grace period and may then be restricted or downgraded if payment remains unresolved. The Partner remains responsible for valid charges incurred before cancellation or downgrade.
ShareDay may change Partner Pro pricing by giving reasonable notice before the new price applies to a future renewal. If the Partner does not accept the change, it may cancel before that renewal. ShareDay will not apply a new recurring charge to a complimentary or Free Partner arrangement unless the Partner expressly accepts a paid subscription.
23.11 Promotion codes and complimentary Partner Pro
Promotion codes, discounts, trials, and complimentary plans may be subject to eligibility, redemption, duration, account, and usage conditions shown when they are offered. They have no cash value, cannot be resold, and may be withdrawn or corrected where obtained through error, duplication, misuse, fraud, or a breach of these Terms.
A 100% discount may still be configured by the payment provider as a subscription and may require a payment method for future renewals, verification, or billing administration. The checkout page and promotion terms determine whether a payment method is required and how long the discount lasts. The Partner should not complete checkout unless those terms match what it expects.
Where ShareDay grants complimentary Partner Pro directly, the confirmation given to the Partner will state the applicable duration or conditions. If the confirmation describes the plan as ongoing, permanent, “free forever”, or otherwise continuing at no charge, ShareDay will not begin charging for that complimentary entitlement unless the Partner later expressly chooses a paid plan. Access may still be suspended or removed for fraud, business closure, ineligibility, misuse, safety concerns, or breach of these Terms.
23.12 Cancellation, closure, suspension, and data
A Partner may cancel Partner Pro using the available billing controls or by contacting ShareDay support. Cancelling the subscription does not automatically delete the Partner account. On downgrade, Pro-only tools, limits, promotional eligibility, and Host-linked benefits may be restricted or removed, while information may be retained for a reasonable period to support reactivation, legal obligations, disputes, security, and record keeping.
A Partner may request account closure or deletion subject to section 14. ShareDay may suspend, restrict, unpublish, or terminate Partner access for non-payment, fraud, impersonation, misleading listings, serious complaints, unsafe or unlawful conduct, misuse of personal information, platform abuse, or breach of these Terms. Where appropriate, ShareDay may preserve relevant records and cooperate with affected users, payment providers, regulators, or law-enforcement agencies.
23.13 No guarantee of commercial results
ShareDay does not guarantee profile traffic, search position, enquiries, bookings, revenue, customer conversion, review scores, promotional reach, uninterrupted availability, or any other commercial result from the Free Partner plan, Partner Pro, Discovery, bookings, analytics, Managed Events, or promotional features. Partners remain responsible for assessing whether the service is suitable for their business.
